1. This matter is taken up through hybrid mode. Order No.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 12th October, 2021 in connection with Athagarh P.S. Case No. 218/2021 corresponding to C.T. Case No.433/ 2021 pending in the court of learned S.D.J.M., Athagarh for the alleged commission of offence under Sections 395/397 of the I.P.C. and Sections 25 and 27 of the Arms Act.

4. Considering the submissions made, the materials on record, the period of detention in custody and the fact that similarly placed co-accused person has already been released on bail as per order passed by this Court in BLAPL No.10828/2021, I am inclined to allow the prayer for bail.

5. Let the Petitioner be released on bail in the aforesaid case on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without fail.

6. The BLAPL is disposed of.

7. Urgent certified copy of this order be granted on proper application.
