This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Learned counsel for the petitioner submits that the petitioner was earlier granted bail but he could not appear before the Court due to his serious ailment of paralysis for which he produced a medical certificate before the Court. The Court in seisin of the case is, however, pleased to issue N.B.W. against the petitioner-Minaketan Nayak by the impugned order. It is specifically submitted by the learned counsel for the petitioner that the CRLMC may be disposed of with liberty to the petitioner to surrender before the Court in seisin of the case and in that event, the petitioner may be granted bail.

Considering the limited grievance advanced on behalf of the petitioner, the CRLMC is disposed of with a liberty to the petitioner to approach the Court in seisin of the case by surrendering himself within four weeks hence and in that event, the learned Court in seisin of the case shall consider the bail application of the petitioner affirmatively and release him on bail on any condition as deem fit and proper. 4.

The CRLMC is disposed of.
