1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.
2. Pursuant to the order passed by this Court on 31.10.2022 the Parties along with their respective counsels are present in Court today.
3. Opp. Party on being asked by this Court is not ready for any sort of conciliation and he is interested to prosecute the matter, which was filed in C.P. No. 43 of 2022 before the learned Judge, Family Court at Nayagarh.
4. The present transfer Petition has been filed by the wife seeking transfer of the said proceeding to the Court of learned Judge, Family Court, Bhubaneswar on various grounds.
5. In spite of due service of notice no counter has been filed by the Opp. Party. Considering the grounds taken and the decisions governing the field, this Court is inclined to allow the prayer made in the transfer Petition.
6. Accordingly, this Court directs the learned Judge, Family Court, Nayagarh to transfer C.P. No. 43 of 2022 to the learned Judge,
