This matter is taken up through hybrid mode.

This CMP has been filed assailing the order dated 28th February, 2014 (Annexure-6) passed by learned Additional District Judge, Titilagarh in F.A.O. No.3 of 2012, whereby the appeal has been allowed reversing the order dated 27th September, 2012 (Annexure-5) passed by learned Additional Civil Judge (Junior Division), Kantabanji in I.A. No.8 of 2012 (arising out of C.S. No.22 of 2012) directing the parties to maintain status quo over the suit property.

None appears for the Opposite Party although he is represented by learned counsel.

Taking into consideration that the interim order of status quo passed by learned Additional Civil Judge (Junior Division), Kantabanji on 27th September, 2012 under Annexure-5 and interim order dated 6th May, 2014 passed in Misc. Case No.460 of 2014, whereby this Court has directed the parties to maintain status quo over the suit property, this Court feels that no fruitful purpose will be served by keeping this matter pending. As the

// 2 // interim order of status quo with regard to construction over the suit property is continuing since 2012, this Court disposes of the CMP with a direction that the order of status quo shall continue till final disposal of the suit.

Since the suit is of the year, 2012, step for its early disposal shall be taken by learned trial Court, if there is no legal impediment for the same. Parties are directed to cooperate with learned trial Court for early disposal of the suit. Urgent certified copy of this order be granted on proper application.
