On his own submission of learned counsel for the petitioner that Order No.

petitioner-plaintiff is yet to file the draft issues. In the circumstance, this Court finds there is no cooperation on behalf of the plaintiff-petitioner for early disposal of the suit. Consequently, the Civil Miscellaneous Petition is not entertainable at this stage which stands dismissed but, however, with liberty to the plaintiff-petitioner to re-approach this Court only after the issues involving the suit are framed.
