This matter is taken up through Hybrid Arrangement Order No.
(Virtual/Physical Mode).

This is an application under Section 439 Cr.P.C. filed by the Petitioner for bail in connection with Kegaon P.S. Case No.5 of 2021, corresponding to C.T. Case No.23 of 2021, pending in the file of learned S.D.J.M., Bhawanipatna, for commission of alleged offences under Sections 457/395 of I.P.C., read with Section 25/28 of the Arms Act. 3.
Heard learned counsel for both the parties. Perused the FIR, Case Diary and statement of witnesses.

Considering the submissions made the material on record, the period of detention already undergone and the fact that several co-accused persons have already been released on bail as per order passed by this Court in BLAPL
// 2 // Nos.4025/2021, 4865/2021, 7873/2021 and 8012/2021, I am inclined to release the Petitioner on bail.

Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the trial court on each date of posting of the case without fail.

The BLAPL is disposed of.

Issue urgent certified copy of this order on proper application.
