This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to set aside the order of cognizance dated 5th June, 2015 passed by the learned Sessions Judge, Kendrapara in G.R. Case No.181 of 2013. 3.
Heard the learned counsel for the parties.

Learned counsel for the Petitioner during course of argument submits that he does not want to press this petition since the Petitioner intends to surrender and move for bail before the court below. However, he submits that direction may be given to the court below to dispose of his bail application sympathetically, as the matter has amicably been settled between the parties.

Considering the aforesaid submission of the learned counsel for the Petitioner, this CRLMC stands dismissed as not pressed.

However, since the Petitioner is ready and willing to surrender before the Court in seisin over the matter and makes a motion for bail, it is directed that if the Petitioner surrenders before the Court in seisin over the matter within three weeks hence and makes a motion for bail, the Court in seisin over the matter shall consider and dispose of the bail application of the Petitioner in accordance with law on the same day taking into consideration all the circumstances.

Urgent certified copy of this order be granted on proper application.
