1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.
2. Heard Mr. B.R. Tripathy, learned counsel for the Petitioner and Mr. S.K. Dash, learned counsel appearing for the Opp. Party.
3. This transfer petition has been filed seeking transfer of C.P. Case No. 14 of 2022 pending before the learned Judge, Family Court, Paralakhemundi, Gajapati to the Court of learned Judge, Family Court, Rayagada.
4. It is contended by the learned counsel for the Petitioner that the Petitioner is the wife and she is now serving at Rayagada and accordingly she has prayed for transfer of the matter on the ground that the distance will be more than 140 k.ms. Though Mr. Dash, learned counsel appearing for the Opp. Party has no objection to the prayer made in the transfer petition, but on the other hand submitted that the proceeding be targeted so that the matter can be disposed of within a short time.

Having heard learned counsel for the Parties and taking into account the grounds taken in the transfer petition as well as the decisions governing the field, this Court is inclined to allow the prayer as made in the transfer petition. Accordingly, this Court directs learned Judge, Family Court, Paralakhemundi, Gajapati to transfer C.P. Case No. 14 of 2022 to the Court of learned Judge, Family Court, Rayagada forthwith on receipt of this order.
6. However, it is observed that the Petitioner-wife shall not take unnecessary adjournment and will file a written statement within a period of two (2) months from the date of transfer of the matter.
