Heard learned counsel for the parties.

The petitioner is seeking pre-arrest bail in connection with Plantsite P.S. Case No. 136 of 2022 corresponding to G.R. Case No. 723 of 2022, pending on the file of the learned SDJM, Panposh for commission of offence under Section 52(a) of the Orissa Excise Act. 4.

Taking into account the submission of the learned counsel for the petitioner and on perusal of the recitals in the F.I.R. that primarily the accusation on the basis of the statement of the co-accused, this Court directs that on surrendering within three weeks hence and moving for bail, the petitioner shall be released on bail by the learned court in seisin over the matter on such terms as deemed just and proper. 5.

Accordingly, the ABLAPL is disposed of.
