This matter is taken up through hybrid mode.

Heard, Mr. P.K. Routray, learned counsel for the petitioner and Ms. S. Mishra, learned Additional Standing Counsel for the State.

Learned counsel for the petitioner undertakes to serve a copy of the petitioner on the learned State counsel in the course of the day.

Defect No.8 as pointed out by the registry is ignored. 5.
Being aggrieved by the order dated 07.08.2019 in C.T. Case No.28 of 2018, by the Learned District and Sessions Judge, Bargarh, issuing order of NBW, the petitioner has approached this Court. While prima facie, this Court does not find any infirmity in the order passed but in order to allow the
// 2 // petitioner to effectively defend himself, it is directed that, in the event, the petitioner surrenders within a period of three weeks hence, he shall be released on bail on earlier terms. 6.
It is made clear that, in the event the petitioner does not surrender within the time fixed, it shall be open to the prosecution to take effective steps in terms of the impugned order.

The impugned order dated 07.08.2019 directing issuance of N.B.W. is set-aside.
8.
While being released on bail, it is directed that the petitioner shall furnish his mobile number and email I.D., if any.

The CRLMC is accordingly disposed of.
10.
Urgent certified copy of this order be granted as per rule.
