The matter is taken up through hybrid mode.

Heard Mr. B.K. Sahoo, learned counsel for the Appellant and Mr. S.B. Udgata, learned counsel for claimant - Respondents. 3.

There is delay of 407 days in filing the appeal. 4.

As per explanation offered, the delay is due to death of the conducting lawyer. But, neither the date of death of the lawyer nor his name has been mentioned in the petition. The delay is not explained specifically. The reasons assigned in the limitation petition are very casual and unsatisfactory. As such, this court is not inclined to condone the limitation. Accordingly, the Misc. Case is dismissed. 5.

Resultantly, the appeal is also dismissed on the ground of limitation.
