Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 10.11.2022 in connection with Gondia PS. Case No. 180 of 2021 corresponding to G.R. Case No. 293 of 2021 pending in the court of learned Sessions Judge, Dhenkanal for the alleged commission of offence under Sections 304/419/269 of IPC.

It is alleged that the petitioner was posing as a Doctor and gave medicines to the villagers. It is further alleged that because of an injection given by the petitioner to the deceased he died for which the case was instituted. During investigation, the Doctor had opined that the death of the deceased was due to septicemia and multi-organ failure and specifically mentioned that it is not due to administration of any improper injection. The Doctor has in
the meantime been examined during trial and has also deposed accordingly. In such view of the matter, I am inclined to allow the prayer for bail.

Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that the petitioner shall personally appear before the trial court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.
