The matter is taken up through hybrid mode.

Heard Mr. D.C. Dey, learned counsel for the owner - Appellant and Mr. P.K. Nayak, learned counsel for claimant - Respondent. 3.

In terms of order dated 7th December, 2018 passed in I.A. No.797 of 2018, the amount has not been deposited by the Appellant yet. Mr. Dey, on the other hand, submits that he has no instruction from the Appellant in this regard.

Accordingly the appeal is dismissed for non-compliance of order dated 7th December, 2018.

The interim order stands vacated.

The statutory deposit made by the Appellant before this court along with accrued interest thereof be refunded to the Appellant on proper identification.
