1. Learned counsel appearing for the Petitioner seeks leave to withdraw the present petition with liberty to file a statutory appeal as available in accordance with law.
2. If such appeal is filed not later than 1st February 2023 accompanied by an application for condonation of delay explaining the delay on account of the pendency of the present writ petition, it will be considered in accordance with law by the appellate authority. If the appeal is filed within the time stipulated along with an application for interim relief, then till such time the appellate authority considers the application for interim relief, the interim order passed by this Court on 20th July 2017 will continue. The Court clarifies that it has not expressed any view in the matter.
3. The writ petition is disposed of as withdrawn with liberty as prayed for in the above terms.
