Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 14.04.2022 in connection with Jaleswar P.S. Case No. 300 of 2021 corresponding to Special Case No. 240 of 2021 pending in the court of learned Sessions Judge-cum-Special Judge, Balasore for the alleged commission of offence under Sections 21(b)/29 of NDPS Act.

Having regard to the fact that no contraband was seized from the possession of the petitioner and he was arrested only on the basis of the statement of the co-accused as also the fact that the coaccused persons from whom the seizure was allegedly made, have already been released on bail as per order passed by this Court in BLAPL No.8577 of 2021, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions
as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the court in seisin over the matter on each date of posting of the case, failing which NBW shall be issued to take into custody again. Further, he shall appear before the IIC of Jaleswar Police Station on every Monday at 10.00 A.M. for a period of six months and such fact shall be certified by the IIC to the concerned Court once every month.

The BLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
