This matter is taken up through hybrid arrangement Order No.
(virtual/physical) mode.

This is the second journey of the Petitioner who is in custody in connection with Pattapur P.S. Case No.407 of 2021 corresponding to S.T. Case No. 53 of 2022 arising out of G.R. Case No.390 of 2021 on the file of learned 3rd Addl. District & Sessions Judge, Berhampur, running for commission of offence under Section-452/376(2)(n)/506 of the IPC, in filing this application under Section 439 of the Cr.P.C. for his release on bail.

Heard learned Counsel for the Petitioner and learned Counsel for the State.

Keeping in view the submissions made; the record being perused; it is found that the victim is yet to be examined in the trial. In that state of affair, keeping in view the earlier order dated 02.02.2022 passed by this Court in BLAPL No.463
// 2 // of 2022 granting liberty to the Petitioner to renew his prayer for grant of bail before the Trial Court after examination of the Victim; this Court finds that the present move does not merit acceptance.

The BLAPL is accordingly dismissed.
