This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The Petitioner is an accused in connection with 2 (a) CC Case No. 19 of 2021 arising out of P.R. Case No. 13 of 2020-21 on the file of learned Sessions Judge-cum-Special Judge, Cuttack, registered for the alleged commission of offence under Section 20(b)(ii)(c) of the NDPS Act. 4.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Sessions Judge-cumSpecial Judge, Cuttack, by order dated 30.03.2021, the present BLAPL has been filed.

Learned counsel for the petitioner fairly submits that in the meanwhile trial has commenced.

Taking into account such submission, this Court calls upon the learned Special Judge, Cuttack to conclude the trial within a period of four months from the date of

receipt/production of certified copy of this order. It shall be open to the petitioner to renew his prayer in the event trial has not concluded within the time stipulated and the delay is not attributable to the petitioner.

The BLAPL is accordingly disposed of.
