The present intra Court appeal filed by the secured creditor/Bank is directed against the order dated 30th March, 2021 passed by the learned Single Judge in W.P.(C) No.9906 of 2021 filed by the defaulting borrower, whereby the Bank was directed to consider the application of the borrower for rephasement of the outstanding dues subject to deposit of a sum of Rs.20.00 lakhs and keep the recovery process having culminated to the stage of auction of the mortgaged property in abeyance. 3.

At the time of hearing, no one appeared for both the parties. Counsel for the Appellant has filed a memo dated 2nd August, 2022 seeking an unconditional withdrawal of the present appeal.
