While not disputing the application at Annexure-4 not supported with an affidavit and such an application is not entertainable in the eye of law after the amendment of the C.P.C. requiring each application be supported with verification and affidavit, learned counsel appearing for the petitioner wants to withdraw the Civil Miscellaneous Petition with liberty to the petitioner to file a better application for consideration of the trial court. Recording the submission of learned counsel appearing for the petitioner, this Court permits withdrawal of the Civil Miscellaneous Petition.
