This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.1966 of 2021, on the files of learned S.D.J.M. (P) Rourkela, arising out of Plant Site P.S. Case No.427 of 2021, under Sections 302/34 of the IPC and is in custody since 07.11.2021.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned 1st Additional District and Sessions Judge, Rourkela by order dated 18.01.2022 in the aforementioned case, the present BLAPL has been filed. 5.
Learned counsel for the petitioner submits that since charge sheet has already been filed and taking into account the nature of
allegations, further continuance of the petitioner in custody would be punitive.

Learned counsel for the State placed on record the statement of one Punam who is an eye witness and wife of the deceased. 7.
Considering the nature of allegations, this Court is not inclined to entertain this application at this stage. The same stands rejected.

Accordingly, the BLAPL stands disposed of.
