Heard the submission of Mr. Satapathy, learned counsel for the petitioner involving a challenge of order at Annexure-13, this Court also takes cognizance of the submission of Mr.Satapathy, learned counsel for the petitioner that crux involving the issue is petitioner's yet to get fire clearance certificate in order to run its establishment. For the opinion of this Court unless the petitioner gets the Fire Safety Certificate from the Competent Authority and since the petitioner's institution is already deempanelled, there is no question of running of such institution unless it is empanelled once again.

In the circumstance this Court finds, there is no scope for interfering in Annexure-13 at this stage. At this stage of the matter Mr.Satapathy, learned counsel for the petitioner seeks liberty of this Court to pursue his remedy before the opposite party No.7 dealing with Fire Safety clearance Certificate. Though the writ petition is declined to be entertained, it may be open to the petitioner if so advised to pursue his remedy before opposite party No.7.
