This matter is taken up through hybrid mode.

The Petitioners in this writ petition seek for a direction to the Tahasildar, Balianta-Opposite Party No.4 to correct the area of Plot No.31, under Khata No.200/68 from Ac.0.03 decimals to Ac.0.05 decimals.

Ms. Sahoo, learned counsel appearing on behalf of Mr. Parida, learned counsel for the Petitioners submits that the Petitioner No.2 had earlier approached the Commissioner, Consolidation and Settlement, Odisha, Bhubaneswar in R.C. No.103 of 2013, which was disposed of on 3rd May, 2017 directing to enhance the area of Plot No.31 under Khata No.200/68 situated in Mouza Bhimpur under Balianta Tahasil in the district of Khordha. But, the Petitioner could not take appropriate steps with the Tahasildar, Balianta for correction of the aforesaid area. After the situation of Covid-19 was
// 2 // normalized, the Petitioner No.1 approached the Tahasildar, Balianta-Opposite Party No.4 by submitting a representation dated 7th December, 2021 for carrying out the order passed in R.C. No.103 of 2013. However, the Tahasildar, Balianta did not take any action on the same. Hence, this writ petition has been filed for the aforesaid relief.

Mr. Dash, learned Additional Government Advocate submits that since the matter is stated to be pending before the Tahasildar, Balianta-Opposite Party No.4, he may take a decision on the same in accordance with law and communicate the result to the Petitioners.

Considering the submissions made by learned counsel for the parties, this Court without expressing any opinion on the merit of the case of the Petitioners, disposes of the writ petition with a direction to the Tahasildar, Balianta-Opposite Party No.4 to take a decision on the grievance petition of the Petitioner dated 7th December, 2021 under Annexure-5 and communicate the result to them as expeditiously as possible preferably within a period of eight weeks from the date of production of certified copy of this order.
Urgent certified copy of this order be granted on proper application.
