03. 1. This matter is taken up through Hybrid Mode.
2. The petitioner is the defaulting borrower of a Cash Credit Facility loan for a tune of Rs.20,00,000/- availed from Andhra Bank, Bhanjanagar Branch, DistrictGanjam. Due to non-servicing of the account, it was classified as NPA on 31.8.2019. A demand notice dated 05.09.2019 was issued by the Bank under Section 13
(2) of the SARFAESI Act, 2002 (for short "the Act, 2002") seeking to recall of Rs.17,54,426.17 due as on 05.09.2019. The Andhra Bank is stated to have merged with Union Bank of India which had initiated further recovery process under the Act, 2002.
3. At the outset, learned counsel for the petitioner states that the present writ petition be permitted to be dismissed as withdrawn as the parties have arrived at an amicable settlement whereby the outstanding liabilities have been liquidated.

4. In view of the above submission, the writ petition is dismissed as withdrawn.
