2. Heard Mr. S. Mallik, learned counsel appearing for the Petitioner and Mr. Y.S.P. Babu, learned counsel for the SateOpposite parties. 3.

The present Writ Petition has been filed with the following prayer:

"1. Direct/order that entire period of service shall be counted for computing pension as per the provision of Rule 21 of the Pension Rules.

2.

Direct/order that the petitioner shall be paid 50% of the initial pay of the post of R.I which he was holding on the date of retirement towards minimum pension with effect from the date of entitlement.

Direct/order that the arrear differential pension shall be paid within stipulated period as may be fixed by this Hon'ble Court with interest thereon."

It is submitted that the claim of the petitioner is squarely covered by the order under Annexure-4 to the Writ Petition.

Taking into account the nature of claim made in the Writ Petition and the prayer made by Mr. Mallik, learned counsel for the Petitioner, the Petitioner is permitted to make a fresh representation before Opp. party No.1 within a period of three weeks from today.

It is observed that if such a representation is filed by the Petitioner ventilating his greivances, the same shall be considered by Opp. party No.1 in accordance with law by relying on the order passed by this Court under Annexure-4 within a period of the three months from the date of filing of such representation. The order so passed by Opp. Party No.1 be communicated to the Petitioner within that time. 7.

With the aforesaid observation and direction, the Writ Petition is disposed of.
