This matter is taken up through Hybrid Mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The petitioner is seeking pre-arrest bail in connection with G.R. Case No.66 of 2022, arising out of Banki P.S. Case No.48 of 2022 pending in the Court of learned S.D.J.M., Banki for the alleged commission of offence punishable under Sections 341/323/324/325/307/294/506/34 of IPC.

Learned counsel for the Petitioner submits that in the meanwhile, the accused against which the specific overt act is attributed has been released on bail by the learned Court in seisin over the matter.

On perusal of the F.I.R. it is seen that the Petitioner is not named therein.

Taking into account the release of the co-accused, this Court directs that on surrendering within three weeks hence and moving for bail, the petitioner shall be released on bail. The learned Court in seisin over the matter to fix the terms and conditions as deemed just and proper.

Accordingly, the ABLAPL stands disposed of.
