This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Additional Standing counsel for the State. In view of the Prisoners Petition appearance of Mr. A.K. Jena is ignored. 3.

The petitioner is an accused in Special G.R. Case No.35 of 2021, on the files of learned Sessions Judge-cum-Special Judge, Malkangiri, arising out of Mathili P.S. Case No.41 of 2021, under Sections 20(b)(ii)(c) of the NDPS Act and is in custody since 05.03.2021.

Taking into account the quantity of ganja seized beyond the commercial quantity and the manner of seizure in view of the bar under Section 37 of the NDPS Act, this Court is not inclined to exercise discretion in favour of the petitioner. Thus, BLAPL stands dismissed.

It shall be open to the petitioner to move this Court at a later stage, if so advised.

Accordingly, the BLAPL stands disposed of.
