This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as learned Addl. Standing Counsel for the State.

This I.A. has been filed for modification of the conditions imposed by this Court in para-10 of the order dated 17.05.2022. 4.

It is submitted by learned counsel for the Petitioner that the prosecution does not have any criminal antecedent in the State of Odisha, but however he has one such criminal antecedent in the State of U.P.

In such view of the matter, it is directed that the learned Court below shall consider the criminal antecedent of the similar nature of the Petitioner and in the event it is found that the Petitioner

// 2 // is having more than two criminal antecedents of similar nature, then the order of bail shall not be given effect to in any way. 6.

With the aforesaid modification in the terms and conditions, the I.A. is disposed of accordingly.
