This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is seeking pre-arrest bail in connection with C.T. Case No.238 of 2021, arising out of Khajuripada P.S. Case No.63 of 2021 pending in the Court of learned S.D.J.M., Phulbani for the alleged commission of offence punishable under Sections 506/323/307/341/34 of I.P.C.

Learned counsel for the Petitioner has placed on record the forwarding report of co-accused Suman Ganda.

On perusal of the same it is seen that while forwarding the co-accused, the I.I.C., Khajuripada P.S. has specifically stated that

the assault was made by one Suman Ganda "who is wrongly referred to as Soumya Ranjan Ganda in written report." 6.

It is submitted by the learned counsel for the Petitioner that in the meanwhile, the principal accused Suman Ganda has been released on bail on 28.07.2021 by the learned Additional Sessions Judge, Phulbani.

Taking note of such submissions and the forwarding report attributing the overt act to the co-accused Suman Ganda, this Court directs that on surrendering within three weeks hence and moving for bail, the petitioner shall be released on bail. The learned Court in seisin over the matter to fix the terms and conditions as deemed just and proper.

Accordingly, the ABLAPL stands disposed of.
