Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 30.10.2021 in connection with Kesinga P.S. Case No. 383 of 2021 corresponding to C.T. Case No. 27 of 2022 pending in the court of learned District & Sessions Judge, Kalahandi at Bhawanipatna for the alleged commission of offence under Section 395 of IPC. 4.

It is alleged that the petitioner and some other persons entered the house of the informant and committed dacoity by threatening to kill them with sharp cutting weapons. The culprits are said to have taken away several gold ornaments, mobile and cash of Rs.7,000/-. The petitioner was identified during T.I. parade. In the meantime, charge sheet has been submitted. 5.

Considering the submissions made, the materials on record,

the period of detention in custody and the fact that charges sheet has already been submitted, I am inclined to allow the prayer for bail.

Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the IIC of Bhawanipatna Sadar police station on every Sunday at 10.00 a.m. till conclusion of the trial. 7.

The BLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
