This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned counsel for the State.

The petitioner being in custody in connection with G.R. Case No.1198 of 2019 arising out of Banarpal P.S. Case No.137 of 2019 pending in the court of the learned S.D.J.M., Angul running for the alleged commission of offence under Sections 395/397, I.P.C. has filed this application under section 439, Cr.P.C. for his release on bail.

It is submitted by learned counsel for the petitioner that the petitioner has been remanded in this case on 06.07.2019 and on similar footing with the present petitioner, co-accused has already been granted on bail by this Court by order dated in 20.11.2019 in BLAPL No.8071 of 2019.

Considering the submissions made and on going through the

// 2 // materials available on record; further keeping in view the factum of release of co-accused on bail as also the period of detention of the petitioner in custody; it is directed that the petitioner be released on bail in the aforesaid case with such terms and conditions as deemed just and proper by the court in seisin of the case with further conditions that he will appear in person before the court in seisin of the case on each and every date of posting of the case till conclusion of the trial and will also appear before the I.I.C., Banarpal P.S., on every Sunday in between 10.00 A.M. to 2.00 P.M. for a period of one year. Violation of any of these conditions shall entail cancellation of bail.

The BLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
