Heard learned counsel for the Parties.

The Writ Petition involves the following prayer :- "The Petitioner therefore prays that your Lordships would be graciously pleased to admit this case, call for records after hearing the parties issue writ/writs in the nature of certiorari/mandamus or any other writs and directions commanding to the Opp. Parties not to deprive the property right of the petitioner and further direct not to take forcible possession of the petitioners property as stated in schedule below without following due process of law."

This Court finds, by order dated 25.7.2008 the Petitioner has been granted interim protection from the eviction involved. Considering the innocuous prayer and further since there is no involvement of taking out such order, this Court finds, there may not be any cause of action surviving any further. In the event any cause
