None appears for the appellant when the matter is called out. 3.

Despite our order dated 27.10.2022 none has appeared for the appellant. It has been observed in the said order as follows: "It is made absolutely clear that, if there is no representation for the Appellant on the next date, this Court will be persuaded to pass an order for non-prosecution."

Since none appears for the appellant, even today, we have no other alternative but to dismiss the appeal for non-prosecution. Accordingly, it is ordered.
