This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are seeking pre-arrest bail in connection with G.R. Case No. 379 of 2022, arising out of NALCO Township P.S. Case No. 94 of 2022 pending in the Court of learned J.M.F.C., Banarpal for the alleged commission of offence punishable under Sections 341/323/307/34 of the I.P.C. 4.

Taking into account the tenor of the allegation being prima facie against Petitioner No.2- Sipun Behera, this Court is not inclined to exercise its discretion in respect of the said

petitioner. The bail application of the petitioner no.2 stands dismissed.

Taking into account the role ascribed to the petitioner no.1- Pradeep Behera @ Nakhia, this Court directs that on surrendering within three weeks hence and moving for bail, the petitioner no.1 shall be released on bail. The Learned Court in seisin over the matter to fix the terms and conditions as deemed just and proper.

Accordingly, the ABLAPL stands disposed of.

Urgent certified copy of this order be granted as per rules.
