This matter is taken up through Hybrid Mode.

Order No 2.

Heard learned counsel for both the Parties.

The present Writ Petition has been filed with the following prayer:- "1. Notice to the Opp.Parties to file their show cuase as to why the writ application shall not be allowed. If the Opp.Parties failed to file their show cause or files in sufficient cause then shall be pleased to direct the Opp.Parties to sanction annual increment in favour of the petitioner along with pay and allowances, attached to the post of ASI of Police from the date it was held ever and to pay all the arrears to the petitioner as per his entitlement within a time framed fixed up this Hon'ble Court, and

2. Or in alternative to give liberty to the Petitioner to file fresh representation before the Opp.Party No.1 agitating his grievances and to direct the Opp.Party No.1 to take a decisions on the same in par with that of the case of Laxmikanta Pattnaik vide Annexure-5".

Taking into account the nature of claim made in the Writ Petition and the prayer made by the learned counsel for the Petitioner, the Petitioner is permitted to make a fresh

// 2 // representation before Opp. party No.1 within a period of three weeks from today.

It is observed that if such a representation is filed by the Petitioner ventilating his grievances, the same shall be considered by Opp. party No.1 in accordance with law and also taking into account the order passed under Annexure-5 within a period of the two months from the date of filing of such representation. The order so passed by Opp. Party No.1 be communicated to the Petitioner within that time. 6.

With the aforesaid observation and direction, the Writ Petition is disposed of.
