None appears for the Petitioner at the time of call. 3.

This RPFAM has been filed assailing the judgment and order dated 26th November, 2008 passed by learned Judge, Family Court, Cuttack in Criminal Proceeding No. 594 of 2006. 4.

Office note indicates that receipt showing service of copy of the brief on the learned counsel for the Opposite Party has not been filed. Further, receipt showing payment of 25% of the arrear amount in the court below is also not filed. On the last occasion, i.e. on 16th August, 2013, when the matter was called, none had appeared on behalf of the Petitioner. Thus, it appears that the parties have lost interest in pursuing the RPFAM. 5.

Accordingly, the RPFAM is dismissed for nonprosecution. 6.

The interim order dated 4th May, 2010 passed in Misc. Case No. 2 of 2010 stands vacated.
