Pravakar Mallik v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
BLAPL No. 3668 of 2022 Pravakar Mallik & Anr.
....
Petitioners Mr. A.R. Panda, Adv.
- Versus - State of Odisha ....
Opp. Party Mr. P. Tripathy, Addl. Standing Counsel
CORAM:
JUSTICE SASHIKANTA MISHRA
ORDER
07.09.2022 1.
This matter is taken up through hybrid mode.
Order No.
03.
2.
Heard learned counsel for the petitioners and learned Addl. Standing Counsel for the State.
3.
The petitioners are in custody since 01.12.2021 in connection with Jajpur Sadar P.S. Case No.325 of 2021 corresponding to C.T. (Sessions) Case No. 10 of 2022 pending in the Court of learned Sessions Judge, Jajpur for the alleged commission of offence under Sections 498-A/306/304-B/34 of IPC, read with Section 4 of D.P. Act.
4.
The petitioners are the parents in-law of the deceased, who is said to have died because of constant torture by her husband and in-laws in connection with demand for dowry. The petitioners had earlier approached this Court in BLAPL No. 370 of 2022 which was rejected granting liberty to renew their prayer after examination of some material witnesses in the case. In the meantime, three witnesses have been examined, all of whom are said to be neighbours. All the three witnesses have turned hostile. Even otherwise the allegations against the petitioners appear to
be omnibus in nature.
5.
Considering the above facts and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioners be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that they shall personally appear before the trial Court on each date of posting of the case without fail.
6.
BLAPL is accordingly disposed of.
7.
Issue urgent certified copy as per rules.
(Sashikanta Mishra) Judge A.K. Rana
