This matter is taken up through hybrid arrangement Order No.

(virtual/physical) mode.

This is the second journey of the Petitioner who is in custody in connection with Bhadrak Rural P.S. Case No.192 of 2021 corresponding to Special (NDPS) Case No.45 of 2021 on the file of learned Special Judge (NDPS)-cum-Sessions Judge, Bhadrak, running for commission of offence under Section- 21(c)/29 of the NDPS Act, in filing this application under Section-439 of the Cr.P.C. for reconsideration of the prayer for grant of bail to the Petitioner in the above mentioned case.

Heard learned counsel for the Petitioner and learned counsel for the State.

Considering the submissions made, further keeping in view the quantity of contraband ganja said to have been seized from the possession the Petitioner as those emanates from the materials on record; as also the surrounding circumstances; at this stage, while

// 2 // being not inclined to reconsider the prayer for grant of bail to the Petitioner; the application stands disposed of with an observation that the Trial Court would do well to fast track the trial as provided in law to procure the attendance of the rest prosecution witnesses for their examination and conclusion of the trial as expeditiously as possible.

The BLAPL is accordingly disposed of.
