Heard learned counsel for the Petitioners.

The Petitioner has a genuine grievance that even though the Vakalatnama in CMP No.300/2022 contains the signatures of three Counsel along with Mr.S.N.B.Ray, learned counsel but the matter was listed on the date without his name and got dismissed for default. It is contended that Mr.S.N.B.Ray, learned counsel for the Petitioner since was unwell on particular date and was unable to attend the case, there was also reason for other Counsel not appearing for their names not appearing in the Cause List. Considering the genuine circumstance, this Court finds, the present CMAPL No.300/2022 should succeed. In the result, allowing the CMAPL this Court restores CMP No.300/2022 to File.
