This matter is taken up through Hybrid mode.

This application under Section 482 Cr.P.C. has been filed by the Petitioner for quashment of the criminal proceeding vide ICC Case No.225 of 2008 pending in the court of learned S.D.J.M., Dhenkanal for commission of offence under Section 138 of the N.I Act.

None appears for the Petitioner, when the matter was called. On the last occasion also, none appeared for the Petitioner.

In such view of the matter, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter and has lost interest in the litigation.

Accordingly, this CRLMC stands dismissed for nonprosecution. 6.

This order be communicated to the trial court immediately.
