This matter is taken up through Hybrid mode.

Petitioner in this writ petition prays for a direction to the Deputy Director, Consolidation, Range-1, Cuttack-Opposite Party No.2 for early disposal of Consolidation Appeal No.6 of 2016 filed under Section 12 of the Odisha Consolidation of Holding and Prevention of Fragmentation of Land Act, 1972 (for short, 'the Act').

Mr. Nanda, learned counsel for the Petitioner submits that although hearing of the appeal has already been concluded but the Deputy Director, Consolidation is not passing the final order thereon. He further submits that there is no legal impediment to pass final order in the Consolidation Appeal No.6 of 2015. The Petitioner has made several endeavours by moving the Deputy Director, Consolidation for early disposal of the appeal but in vain. Hence, this writ petition has been filed.

Mr. Mishra, learned AGA submits that he has no instruction in the matter. However, if there is no legal impediment, necessary direction may be issued for early disposal of Consolidation Appeal No.6 of 2015. 5.

Taking into consideration the submissions made by learned counsel for the parties, this Court, without expressing any opinion on the merits of the case of the Petitioner in Consolidation Appeal No.6 of 2015, directs that on production of certified copy of this order before the Deputy Director, Consolidation, Range-1, Cuttack-Opposite Party, he shall do well to consider and dispose of the said Consolidation Appeal, as expeditiously as possible, preferably within a period of six months there from by passing a reasoned order giving opportunity of hearing to the parties concerned, if there is no legal impediment.

With the aforesaid and direction, the writ petition is disposed of.

Issue urgent certified copy of the order on proper application.
