The order of the Deputy Superintendent of Police, Dhenkanal, releasing the accused under Section 41-A Cr. P.C., though he was charged under the provisions of the S.C.&S.T. (Prevention of Atrocities) Act, is challenged in this WPCRL under Article- 226 of the Constitution of India.

Regard being had to the facts and submissions, the petitioner, if so advised, may file a petition U/S. 482 Cr. P.C. instead of a petition for Habeas Corpus.

Certified copy of Annexure-1 be returned to the learned counsel for the petitioner on substitution of the same by true xerox copy.
