This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 439 of Cr.P.C. in connection with Malkangiri P.S. Case No. 26 of 2020 corresponding to T.R. Case No.24 of 2020 pending in the Court of learned Addl. Sessions Judge -cum- Special Judge, Malkangiri for offence punishable under section 20(b)(ii)(C) of the N.D.P.S. Act.

The petitioner moved an application for bail before the Court of learned Addl. Sessions Judge -cum- Special

// 2 // Judge, Gu Malkangiri, which was rejected on 22.11.2021. Perused the status report dated 06.09.2022 furnished by the learned trial Court from which it appears that out of fifteen charge sheet witnesses, thirteen witnesses have already been examined and the learned trial Court further mentioned that case is expected to be disposed during this quarter of 2022 and the next date of hearing was fixed to 14.09.2022 In view of the progress of trial so far as per the status report furnished by the learned trial Court, while not inclining to release the petitioner on bail, it is observed that in the event the trial is not concluded by the end of December 2022, the petitioner is at liberty to renew his prayer for bail.

With the aforesaid observation, the BLAPL stands disposed of.
