This application has been filed for condonation of delay of 11 days in preferring the CMAPL.

Heard Mr. D.K. Mohapatra, learned counsel for the petitioner and Mr. Dayananda Mohapatra, learned counsel for opposite party no.4.

Having heard learned counsel for the parties and on perusal of the affidavit filed along with the application, this Court is satisfied with the sufficiency of cause of 11 days delay in filing the CMAPL application.

The delay is condoned and the application is accordingly allowed.

This application has been filed for recalling of the order dated 02.11.2017 passed in CONTC No.2876 of 2012.

As it appears, the contempt petition is of the year 2012 and, as
such, when CONTC No.2876 of 2012 was listed on 02.11.2017, none appeared for the petitioner on that date. Therefore, this Court observing therein that there was no merit, dismissed the contempt petition. 4.
In the above view of the matter, this Court is not inclined to recall the order dated 02.11.2017 passed in CONTC No. 2876 of 2012. 5.
Accordingly, the CMAPL stands dismissed.
