Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 14.01.2022 in connection with Khallikote P.S. Case No. 21 of 2022 corresponding to G.R. Case No. 47 of 2022 pending in the Court of learned J.M.F.C., Khallikote for the alleged commission of offence under Sections 341/294/323/324/307/506/34 of IPC.

His earlier bail application before this Court being BLAPL No. 1177 of 2022 was disposed of granting liberty to move the court below. Subsequently, the petitioner's bail application being rejected by the court below, he has approached this Court. 5.

The prosecution case is that the petitioner along with five other persons assaulted the informant and his family members by means of a sword causing severe bleeding injuries on their persons. The injury report shows injury to vital parts as also the nature is

grievous. Be that as it may, charge sheet has already been submitted. The petitioner is a local resident. 6.

Considering the above facts and taking into account the period of his detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that:- (i) He shall personally appear before the trial court on each date of posting of the case personally failing which NBW shall be issued to take him into custody again. (ii) He shall appeal before the IIC of Kahilikote PS on every Sunday between 9.00 a.m. to 12.00 noon till conclusion of the trail and such fact shall be certified by the IIC to the concerned Court once in a month. (iii) He shall not threaten the informant or his family members and any manner whatsoever.

Violation of any of these conditions shall entail automatic cancellation of the bail.

8. The BLAPL is accordingly disposed of. 9.
