1. Heard Mr. A. P. Bose, learned counsel for the Petitioner and Order No.
Mr. P. P. Behera, learned counsel for the Opposite Parties.
2. The present petition under Section 11(6) of the Arbitration and Conciliation Act, 1996 seeks the appointment of an Arbitrator to adjudicate the disputes between the Petitioner and the Opposite Parties arising out of an Agreement dated 22nd May, 2013 between the parties.
3. Learned counsel for the parties are agree that a former judge of this Court could be appointed as the sole Arbitrator to adjudicate the disputes between the parties.
4. Leaving all the questions raised by both the parties open to be urged before the learned Arbitrator, with the consent of the parties and without prejudice to their rights and contentions, the Court
appoints Shri Justice M. M. Das, former judge of this Court as the sole Arbitrator to adjudicate the disputes between the parties. The arbitration shall take place under the aegis of the High Court of Orissa Arbitration Centre.
5. The arbitration petition is disposed of accordingly. A copy of this order be communicated to the Coordinator, Orissa Arbitration Centre and the learned Arbitrator forthwith.
