Heard learned counsel for both the parties.

Referring to the condition in the agreement of donation of the land involved a claim is made. The land is donated by the Petitioner has not been utilized over a period of three decades. But there is already an application vide Annexure-8 to the Revenue Authority for considering return of the land. It appears that there is no positive response to such request of the Petitioner. However, the request of the Petitioner has been sent to the Collector, Bolangir, Opposite Party No.3 for examination and enquiry before taking any decision. Considering the fact that the request of the Petitioner is pending consideration, it also appears that there is subsequent correspondence vide Annexure-11.

Be that as it may, for the pendency of the request of the Petitioner vide Annexure-8, a decision is required to be taken by the Revenue Divisional Commissioner, Sambalpur, this Court in disposal of the writ petition directs the R.D.C., Sambalpur to take a lawful decision on the application of the Petitioner under Annexure-
// 2 // 8 by completing the entire exercise within a period of two months from the date of communication of this order by the Petitioner. In the consideration process, the conditions in the Gift Deed of the Petitioner shall also be taken into account.

With the above direction, the writ petition stands disposed of.
