This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioners and learned counsel for the State.

Learned counsel for the petitioners does not want to press the application for bail, so far as Petitioner No.1 is concerned. Accordingly, the present ABLAPL in respect of Petitioner No.1 is dismissed as not pressed.

Petitioner No.2-Sachindra Das is seeking pre-arrest bail in connection with C.T. Case No.356 of 2022, arising out of Remuna P.S. Case No. 65 of 2022, pending in the Court of learned J.M.F.C.(R) Balasore for the alleged commission of the offence punishable under Sections 341/323/294/506/34 of I.P.C.

Taking into account the nature of allegation, this court directs that on surrendering within three weeks hence, and moving for bail, the Petitioner No.2 shall be released on bail. The learned Court in seisin over the matter to fix the terms and conditions as deemed just and proper.

It is submitted by the learned counsel for the petitioner that the petitioner no.2 has no criminal proclivity. While enlarging the petitioner no.2 on bail, the learned Court below shall verify such assertion. If it comes to the fore that the petitioner no.2 has any criminal antecedents, this order shall stand recalled automatically without any further reference to this Court. 7.
The ABLAPL is disposed of accordingly.
