None appears for the Petitioner at the time of call. Learned counsel for the Opposite Party is present. 3.

This RPFAM has been filed assailing the order dated 6th February, 2010 passed by learned Judge, Family Court, Cuttack in Crl. Execution Case No. 762 of 2008. 4.

From the order sheet, it appears that after issuance of notice to the Opposite Party on 30th March, 2010, no step is taken by the Petitioner to get the matter listed. However, the matter was listed on 16th August, 2013 and was adjourned on the prayer of learned counsel for the Petitioner. 5.

In that view of the matter, it appears that the Petitioner has lost interest in pursuing the matter.

Accordingly, the RPFAM is dismissed for nonprosecution.

The interim order dated 30th March, 2010 passed in Misc. Case No. 27 of 2010 stands vacated.
