Heard the submissions of the respective parties. 2.

It appears, finding the D.D. Court-Appellate Court not functioning for over a period of time, the Petitioner was constrained to file this Writ Petition challenging the order at Annexure-5. There is no dispute at Bar that in the meantime the Appellate Court has started its functioning.

In the circumstance this Court finds, the Writ Petition is not entertainable. However since the Petitioner has pursued the writ remedy, this Court in disposal of the Writ Petition permits the Petitioner to prefer the appeal within a period of three weeks hence. Grounds raised herein can very well be raised in appeal. 4.
