This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with Jatni P.S. Case No.692 of 2021, corresponding to T.R. Case No.8 of 2022 on the file of learned Additional Session and District Judge, POCSO, Khurda at Bhubaneswar for commission of offences under Sections 363/366 of I.P.C. subsequently the same were turned under Sections 363/366 /376(2)(n) of I.P.C. r/w. Section 6 of POCSO Act and is in custody since 07.01.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Bhubaneswar, by order dated 04.04.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the nature of allegations, 164 Cr.P.C. statement of the victim girl and the period of custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin of the matter, so as to ensure the presence of the petitioner on each date of trial.

Accordingly, the BLAPL stands disposed of.
